Is the land going to be ‘re-acquired’ by Council or is it in a ‘mine subsidence area’? These are but a few of the issues that you need professional assistance to protect your rights.
- You need an expert team to advise you on issues relating to ‘exchange of contracts’ and ‘cooling off periods’ particularly in respect of loan approval ‘pre’ or ‘unconditional’ and the difference between the two.
- You will need a competent Lawyer to advise you on your loan documentation and your legal responsibilities that follow the mortgage.
Selling
If selling a property, you need expert assistance in drafting of the contract. Making disclosures about the property that may affect title. Appropriate disclosures about unapproved development or structures on the land.
Obtaining the prescribed documents including the ‘deposited plan’, the ‘drainage diagram’ and the ‘149 Certificate’ from Council.
